Rottweiler Warranty
1) The breeder has endeavoured through good breeding practice to reduce the risk that the Rottweiler purchased may suffer from the following six defects:
(a) Hip Dysplasia (Greater than that accepted under the current National Rottweiler Council Scheme),
(b) Elbow Dysplasia (Greater than that accepted under the current National Rottweiler Council Scheme),
(c) Entropian, Ectropian,
(d) Faulty Bite,
(e) Monorchidism,
(f) Cryptochidism.
1.1: The above mentioned defects (as stated clause 1) will henceforth be referred to as: “The Defects”. No additional medical conditions or breed faults are subject to coverage in this warranty. Arbelterhund Kennels (Nairn & Lee Whatling) assumes no responsibility for costs / inconvenience incurred through defects or conditions not listed in clause 1.
2) The Purchaser/s are purchasing the Rottweiler as a *Main Register*, or #Limited Register# pertaining to the provisions of clause 1.1 above, if within twenty four (24) Months of the date of whelp the Rottweiler:
(a) If purchased as a Main Register, suffers from any one of the defects listed in clause 1/1.1 or,
(b) If purchased as a Limited Register, suffers from Hip Dysplasia or Elbow Dysplasia only,
It is agreed by the breeder and the purchaser/s, that the liability of the Breeder to the Purchaser, caused by or arising out of the existence of any of the listed defects (1 / 1.1) in the Rottweiler, shall at the sole discretion of the Breeder, be limited to:
The refund to the Purchaser/s of not more than 50% of the purchase price upon the return of the registration papers and proof of desexing if the Purchaser/s wishes to keep the dog or, the provision of a replacement puppy (when one becomes available) from the Breeders stock upon delivery / surrender of the original animal to the breeder.
2.1: It is the responsibility of the Purchaser/s to notify the Breeder within twenty eight (28) days when a defect is suspected and prior to any surgery, to facilitate the implementation of clause 2.2.
2.2: The Breeder shall have the right to have the animal examined by a veterinarian of their choice to verify the existence and extent of any defect complained of by the Purchaser/s.
2.3: In the absence of such notification (clause 2.1) and the provision of such examination (clause 2.2) the Purchaser/s relinquish the right to replacement or refund and Arbelterhund Kennels (Nairn and Lee Whatling) are not bound by the terms of this warranty due to breach of contract on the behalf of the Purchaser/s.
3) The Purchaser/s agrees that the Breeders Nairn and Lee Whatling and the kennel Arbelterhund will not be held responsible for any expenses at present or in future incurred by the Purchaser/s to the fore named Rottweiler.
4) The Purchaser/s agree that no monies shall be payable by the Breeders to the Purchaser/s other than for the circumstances outlined in this warranty.
5) It is a condition of this warranty agreement that the Purchaser/s shall first offer the animal for sale to the Breeder, at a price no greater than the purchase price if for whatever reason the purchaser/s elect not to keep the animal. If the Breeder elects not to buy the Rottweiler, the purchaser/s will allow the Breeder to participate in the selection of the new owner.
6) If the puppy is purchased as a #Limited Register# animal then the Breeder shall refund the amount of one hundred ($100.00) dollars to the purchaser/s when a certificate of sterilization is received by the Breeder from the purchaser/s as proof that the fore named dog has been desexed.
6.1: This money is only redeemable if the fore named dog is desexed prior to seven months from the date of birth.
6.2: The money will be issued in the form of money order or cheque.
*Main Register* - The animal can be used for breeding and/or showing.
#Limited Register# - The animal cannot be used for breeding and/or showing.
